Expert Witness Testimony

In 2001 B&D was engaged by Myers & Frayne Co., L.P.A. to provide a valuation of the Dayton Dragons Class “A” Minor League Baseball franchise as expert witness testimony in support of litigation related to an ownership dispute. We completed a “fair market value” opinion of a professional baseball franchise operating in Dayton, Ohio under the conditions that the proposed ownership group known as Sports Spectrum, Inc. (or “Baseball at Trotwood, LLC”) would have most likely operated. Those conditions were assumed to respond both to the intended operating strategies of Sports Spectrum and to the dynamics of the Dayton market. Our valuation was based on both a market-comparable sales approach and a discounted cash flow approach, the latter of which was based on detailed projections of the team’s financial performance based on a review of all available development and lease documents. We discovered that, based on the attendance experienced during the 2000 baseball season by the Dragons, Dayton had proven to be stronger than Sports Spectrum’s initial operating projections assumed. We provided a written valuation opinion and B&D’s president, Chris Dunlavey, was deposed by the opposing attorneys relative to the report.
